Last Word

These terms are an agreement between you and Axios Productions LLC about the Last Word app. Installing or using the app means you accept them. If you don't, don't use the app.
If you installed Last Word from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and wins wherever it conflicts with this document. On Google Play, this document is the agreement.
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Last Word on devices you own or control, for your own use.
We keep every other right in the app itself: its code, its design, its bundled beats, and its rhyme word lists.
You own everything you record. We claim no rights in it, we don't publish it, and we have no server that stores it. Recordings live on your device until you delete them.
There is one exception, and you trigger it deliberately: when you play a round against the AI, or turn on AI rating, you are asking us to send that round's recording to Google so a model can write a reply verse or score your verse. That happens only for rounds where you switched the feature on. The Privacy Policy sets this out in full.
Last Word has no accounts, no feed and no messaging. There is no way for one person's recording to reach another person inside the app. Anything you share, you share yourself, through your phone's own share sheet.
Freestyle, PvP and PvCOM are free and unlimited, and work with no internet connection. The app is never locked as a whole.
The AI features — a written and performed response verse, and AI rating — are what Last Word Pro pays for. A small number of AI rounds are granted free so you can try them before deciding. Subscribers also have a generous daily ceiling on AI use, which exists to stop abuse rather than to ration normal play.
Last Word Pro is an auto-renewing subscription, offered monthly or yearly.
The response verses and the ratings are produced by a machine-learning model. They can be wrong, dull, repetitive, or occasionally nonsense. A rating is entertainment. It is not an assessment of your ability, and nothing in it should be read as advice about anything.
These features need an internet connection and depend on a third-party service that may be slow, unavailable, rate-limited or discontinued. We may change the usage limits, or withdraw the AI features entirely. If we withdraw them permanently while you're paying for them, you can cancel your subscription; the store's refund policy applies.
We're responsible for Last Word. We aren't responsible for those services' own availability or conduct.
Last Word requires Android 7.0 or later. We may update, change or discontinue the app or any part of it. Updates may add, change or remove features, including free ones — though we won't put a mode that is free today behind the paywall without saying so.
To the fullest extent the law allows, Last Word is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that recordings will never be lost.
Back up anything you can't stand to lose. Recordings are stored only on your device. Deleting the app deletes them.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost data, lost recordings, lost profits or lost opportunities, arising out of your use of the app.
Where we are liable, our total liability to you is limited to the amount you actually paid us for Last Word in the twelve months before the claim arose.
Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you. If you're a consumer, you keep every right your local consumer law gives you.
You can end it at any time by uninstalling the app. Cancel any active subscription in the store first — uninstalling on its own does not cancel it.
We may suspend or end your licence if you materially breach these terms. Sections 2, 8, 9 and 12 survive.
We may update these terms. When we do, we'll change the effective date at the top, and for changes that materially affect you we'll say so in the app or on the store listing. Continuing to use Last Word after a change means you accept the updated terms.
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-laws rules. If you're a consumer, this doesn't deprive you of the protection of the mandatory law of the country you live in.
